AI provider
Whoever develops an AI system or model (or has it developed) and places it on the market or puts it into service under its own name or trademark.
The provider (Article 3(3)) is the person or company that develops an AI system or model, or has it developed, and places it on the market or puts it into service under its own name or trademark, whether for payment or free of charge. It is the role with the most obligations: for a high-risk system it is responsible for technical documentation, conformity assessment, CE marking and post-market monitoring.
Beware: you can become a provider without realising. Article 25 says a distributor, importer or deployer becomes a provider if it puts its name or trademark on a high-risk system, makes a substantial modification to it, or changes its purpose so that it becomes high-risk.
For example, a company that takes a general model and turns it into its own candidate-screening tool sold to other clients is acting as the provider of a high-risk system.
