Brazil AI Bill (PL 2338/2023)
Brazil’s risk-based AI bill, inspired by the AI Act; passed by the Senate in 2024 and pending in the Chamber of Deputies.
PL 2338/2023 is the bill that would regulate AI in Brazil with a risk-based approach very similar to the AI Act: prohibited uses, high-risk systems with impact assessment and human oversight, rights for affected people and a national supervision system.
The Senate passed it on 10 December 2024 and it is now in the Chamber of Deputies, where a special committee is reviewing it. The vote planned for 2026 slipped and the rapporteur said work would resume after the October elections. It is not law and its text may change.
Meanwhile, any AI processing personal data in Brazil is already subject to the LGPD and to the ANPD's supervision.
