AI regulation in Latin America

In a nutshell

The region is moving at different speeds: Peru has regulations for its AI law, Brazil, Chile and Mexico are processing bills and others rely on data protection laws.

There is no "Latin American AI Act", but very different situations:

  • Peru: Law 31814 promotes the use of AI and its 2025 regulations include a risk-based approach, prohibited uses and human oversight.
  • Brazil: PL 2338/2023 is pending in the Chamber of Deputies.
  • Chile: a risk-tiered bill in Congress and an updated National AI Policy.
  • Mexico: several bills under discussion in Congress.
  • Uruguay: first country in the region to sign the Council of Europe Framework Convention on AI.
  • Argentina and Colombia: no AI-specific law; their data protection laws apply.

Many Latin American companies selling in Europe must already comply with the AI Act, and using it as a reference prepares them for the local laws to come.
