AI regulation in India

In a nutshell

India has no AI law, but since February 2026 its IT Rules require labelling synthetic content and removing unlawful content within 3 hours.

India has no specific AI law. Regulation comes through its Information Technology Rules, amended in February 2026: permitted synthetic content must carry a visible label and permanent provenance markers that platforms must not allow to be removed, and takedown orders from a court or the government must be complied with within 3 hours (previously 36).

On top of that comes the 2023 Digital Personal Data Protection Act (DPDP), whose implementing rules are being rolled out in phases.

For companies with platforms or digital services with users in India, labelling AI-generated content and fast takedown capability are currently the most relevant obligations.
